Foreign students and the Olympic Games: a new exception to the limitation of working time.

Surprise hidden in the Official Journal of May 20, 2023: foreign students will be able to work without time limit...under certain very restrictive conditions.

1. As a reminder, foreign students can only work on an ancillary basis if they do not have a work permit.

In principle, a foreign national holding a "student" residence permit can carry out a professional activity on an ancillary basis without a work permit within the limit of 60% of the annual working time (964 hours in general, 850 hours for Algerian nationals ).


As an exception, certain activities are not taken into account in this count (for example, compulsory internship with a tripartite agreement).

2. During the Olympic Games, foreign students may exercise a security function without time limit.

A new exception has just been published, in article 12 of law n°2023-380 relating to the 2024 Olympic and Paralympic Games.


A foreign student will be able to work indefinitely and without this job being taken into account in the calculation of the 964 hours under several cumulative conditions:

 

1️⃣ He will have to carry out a private security activity within the meaning of article L. 611-1 of the internal security code (CSI)

 

2️⃣ This activity must aim to guarantee the security of the Olympic and Paralympic Games

 

3️⃣ It must be exercised between July 1, 2024 and September 15, 2024
